Terms of Service

These Terms of Service ("Terms") govern your access to and use of the products, services, and website provided by BitSentry ("BitSentry," "we," "us," or "our"), including the BitSentry Dashboard, SuperTerminal, and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Definitions

  • "Customer" means the individual or entity that subscribes to or uses the Services.
  • "Authorized Users" means individuals authorized by the Customer to access the Services.
  • "Customer Data" means data submitted, stored, or transmitted through the Services by or on behalf of the Customer.
  • "Services" means the BitSentry Dashboard, SuperTerminal, and any related products, features, and support.
  • "Subscription Fee" means the fees payable for access to the Services as set out on the pricing page or in an order form.

2. Access to Services

Subject to these Terms and payment of applicable fees, BitSentry grants you a non-exclusive, non-transferable, non-sublicensable right to access and use the Services during the subscription term. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree not to:

  • Share account credentials between multiple individuals
  • Attempt to gain unauthorized access to the Services or related systems
  • Reverse engineer, decompile, or disassemble the Services
  • Remove or modify proprietary notices or labels
  • Use the Services for any unlawful purpose

3. SuperTerminal (Desktop Application)

SuperTerminal Community Edition is open source software licensed under the GNU Affero General Public License v3 (AGPL-3.0). You may use, modify, and distribute SuperTerminal CE in accordance with the AGPL license terms.

SuperTerminal Pro is a paid upgrade ($149 lifetime deal) that includes additional features and a commercial license. The commercial license permits use without AGPL obligations (no requirement to disclose source code of your modifications).

SuperTerminal connects directly to your servers via SSH and to your chosen AI provider via API. BitSentry does not access, store, or transmit your SSH credentials, server logs, or AI conversation data through our infrastructure.

4. Dashboard (Web Application)

The BitSentry Dashboard is a hosted web application. BitSentry hosts the software and is responsible for its availability. You are responsible for maintaining your network infrastructure and connectivity. Customer Data processed through the Dashboard is subject to our Privacy Policy and any applicable data processing agreement.

5. Customer Data

You retain all rights to your Customer Data. By using the Services, you grant BitSentry a limited license to use Customer Data solely for the purpose of providing and improving the Services, including generating aggregated and anonymized analytics.

You represent and warrant that you have all necessary rights to submit Customer Data and that such data does not infringe the rights of any third party or violate applicable law.

You are responsible for maintaining your own backups of Customer Data.

6. Fees and Payment

Subscription Fees are as set out on our pricing page or in an applicable order form. Fees are non-refundable except as expressly stated in these Terms.

  • Subscriptions renew automatically at the end of each term unless cancelled with 30 days' written notice.
  • You are responsible for all applicable taxes except taxes on BitSentry's income.
  • Unpaid amounts may accrue interest at 1.5% per month (or the maximum rate permitted by law).

7. Free Trial and Beta

We may offer free trials or beta access to certain Services. Free trial and beta features are provided "as is" without warranties. We may modify, suspend, or discontinue trial or beta features at any time without notice. No refunds are applicable for free or beta Services.

8. Third-Party Services

The Services may integrate with third-party platforms (e.g., Sentry, PagerDuty, Datadog). These integrations are provided for your convenience. BitSentry does not provide warranties or support for third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

9. Intellectual Property

Intellectual property rights in the BitSentry Dashboard, SuperTerminal Pro commercial license, and branding belong to BitSentry. SuperTerminal Community Edition is licensed under AGPL-3.0, which grants specific rights to use, modify, and distribute the software under the terms of that license.

Except as permitted by the AGPL for SuperTerminal CE, you may not sublicense, sell, or distribute any part of the Services.

If you provide feedback or suggestions regarding the Services, you grant BitSentry a perpetual, worldwide, royalty-free license to use such feedback for any purpose.

10. Warranties and Disclaimers

BitSentry warrants that the Services will perform substantially as described in the documentation during the subscription term. Your sole remedy for a breach of this warranty is support and bug fixes.

EXCEPT AS EXPRESSLY STATED ABOVE, THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITSENTRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.

BITSENTRY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless BitSentry from any claims, damages, or expenses arising from your breach of these Terms, your use of the Services, or your Customer Data.

13. Confidentiality

Each party agrees to protect the other party's confidential information with the same degree of care it uses to protect its own confidential information. Confidential information does not include information that is publicly available, independently developed, or already known to the receiving party.

14. Term and Termination

These Terms are effective from the date you first access the Services and continue until terminated. Either party may terminate for material breach that remains uncured 30 days after written notice.

Upon termination:

  • All rights to access the Services terminate immediately.
  • Customer Data will be available for download for 30 days, after which it will be deleted.
  • No refunds for prepaid fees, except where required by law.

15. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved in the courts of Jakarta, Indonesia.

16. General

  • BitSentry may update these Terms from time to time. Material changes will be communicated via our website or email.
  • These Terms constitute the entire agreement between you and BitSentry regarding the Services.
  • If any provision is found invalid, the remaining provisions remain in effect.
  • BitSentry's failure to exercise a right does not constitute a waiver.
  • You may not assign these Terms without our written consent.
  • BitSentry is not liable for delays caused by events beyond reasonable control (force majeure).
  • The parties are independent contractors.
